Terms of Sale

These are the terms on which Pack Merchants supplies goods. They are written plainly on purpose. If anything here is unclear, ask us before you order.

1. Who these terms are between

They are between Pack Merchants (“we”, “us”) and the person or business placing the order (“you”). They apply to every order placed through this website and to every quotation we issue.

2. We sell in bulk only

The minimum order is 1,000 units on every product. What counts as a unit is stated on each product page — a mailer, a box, a wrap, a roll, a sheet, a metre or a label. We do not supply samples and we do not accept orders below the minimum.

3. How an order is formed

Placing an order on this website is an offer to buy, not a completed contract. A contract exists when we confirm acceptance of your order in writing.

We may decline an order — for example where goods are unavailable, where a price has been listed in error, where we cannot deliver to the address, or where we are not satisfied the order is genuine. If we decline after you have paid, we refund you in full.

4. Prices

  • Prices are shown in US dollars and exclude freight and any applicable tax.
  • Quantity tier prices apply at the quantities shown against each product. A tier applies from its quantity upward until the next tier begins.
  • Prices marked planning estimate are our working figures from supplier indications, not confirmed quotations. We will not hold you to one, and you should not budget a large order against one — ask us for a firm price.
  • Above the quantity marked quoted from on a product, we price by quotation rather than online.
  • We may correct an obvious pricing error at any time before we accept your order.

5. Quotations

A quotation is valid for the period stated on it, and for the specification quoted. Changes to specification, quantity or delivery location may change the price. If a quotation has expired, ask us to requote rather than assuming the old figure stands.

6. Payment

You choose a payment method when you order: bank transfer, or cryptocurrency in USDT or BTC. Nothing is charged on this website. We confirm stock and freight, email you the total and the payment details for your chosen method, and dispatch once payment has cleared in full.

We do not accept cards and we never ask for card numbers. Our payment details reach you only in an email from us quoting your order number. If you receive payment details any other way, or anyone tells you our details have changed mid-order, stop and contact us before sending anything.

For cryptocurrency, the coin amount is fixed against your order total at the moment we send the details and held for the window stated in that email. If payment arrives outside that window at a materially different value, we will contact you to settle the difference before dispatch.

7. Delivery

Delivery timescales are estimates and are given in good faith. Freight is quoted against your consignment and address, and you approve it before paying. Full detail is in our delivery policy.

8. Title and risk

Goods remain our property until we have received payment in full. Risk in the goods passes to you on delivery.

9. Specification and tolerance

Stock goods are supplied to the specification published on the product page at the time of your order. Made-to-order goods are subject to the manufacturing tolerances set out in our returns policy — broadly, up to 10% on quantity and a small variance on dimensions and colour.

Product photography on this site includes illustrative renders where supplier photography is not yet available, and those are labelled as such. Where an image and a written specification disagree, the written specification is what we supply.

10. Claims about materials and certifications

We publish the specification our supplier provides for the production run you receive. Where a recycled percentage or a compostability certification applies to a specific run rather than to the product generally, we say so on the product page.

If you intend to make an environmental or certification claim on your own packaging based on what you buy from us, ask us for the current run documentation first and base your claim on that document — not on this website.

11. Returns and cancellation

Set out in our returns policy, which forms part of these terms.

12. Our responsibility to you

We will supply goods that match the specification we published, with reasonable care and skill.

If we get something wrong, our responsibility is to put the goods right — by replacing them or by refunding what you paid for them, including freight both ways. Except where the law does not allow us to limit it, our total responsibility for any order is limited to the amount you paid for the goods in question, and we are not responsible for indirect losses such as lost profit, lost contracts or business interruption.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not permit us to limit.

You are responsible for satisfying yourself that a product suits your intended use. We will advise where we can, and we will tell you honestly when we do not know.

13. Things outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control — for example carrier failure, supplier failure, industrial action, extreme weather, or restrictions imposed by an authority. If such an event is likely to cause serious delay, we will tell you and you may cancel the affected part of the order for a full refund.

14. Your information

How we handle your information is set out in our privacy policy.

15. General

  • If any part of these terms cannot be enforced, the rest still applies.
  • If we do not insist on something straight away, that does not stop us insisting later.
  • You may not transfer your order to someone else without our written agreement.
  • These terms, together with your order confirmation and any quotation, are the whole agreement between us.

16. Which law applies

These terms are governed by the law of the State of California, and any dispute will be dealt with by the courts of the State of California.
